All of our actions at NEST+m are governed by the NYC Department of Education’s Chancellor’s Regulations.
STUDENT CELL PHONE & ELECTRONIC DEVICE POLICY

NEST+m Electronic Device Policy (Updated July 2025 as per state law). For the purposes of this policy, the term electronic device means: Cell phones, smart watches, smart glasses, internet enabled wearables, video gaming devices, e-readers, tablets, laptops, digital communication devices, headphones, earpods, bluetooth speakers, bluetooth devices, and any other internet enabled electronic device.
- Personal Electronic Devices may not be used anywhere on campus from 7:45am - 2:35pm for all students in grades K-12. Students assembled in the auditorium or cafeteria awaiting bussing or after school programs may not use electronic devices until they have exited the building even if this time is past 2:35.
- NEST+m will provide velcro sealing pouches for the storage of small electronics. Students who need to bring larger electronic devices must provide their own storage pouch for such devices (laptop, tablet, gaming device, etc…) Backpacks are not an acceptable storage device for large electronic devices as per DOE policy.
- Students in all grades will keep their sealed pouches in their backpacks, cubbies, or lockers.
- Students are never allowed to use cell phones or electronic devices in locker rooms, bathrooms, staircases, the auditorium or outside of classrooms.
- Cell phones, computing devices and portable music and entertainment systems may not be turned on or used during school fire drills or other emergency preparedness exercises.
- Students may not record, film, photograph, stream or broadcast anywhere in the building or on school buses or school trips.
- Unauthorized use of cell phones or electronic devices for any reason, including bullying, harassment or academic dishonesty (including cheating, plagiarism or unauthorized collaboration) may result in disciplinary action as specified by the school's Academic Honesty Policy and the New York City Department of Education Discipline Code.
- Cell phones and electronic devices used in violation of these policies will be confiscated.
– For the first offense students will be given a warning. (first 2 days only).
– For a second offense, the device will be confiscated and parents will be contacted; confiscated devices will be returned to students at the end of the day in Room 319 6-12, or main office grades K-5.
– Students in violation of the policy a third will have a disciplinary conference and be required to turn their devices in daily - Refusal to comply with the confiscation of any device is considered insubordination and will result in further disciplinary action, including possible suspension.
- Students are responsible for maintaining the safety and security of their electronic devices while at school.
- Students who lose their pouch will be responsible for purchasing a new one from the school at a cost of $20 per pouch.
- Exceptions to this policy will be made for:
- Documented medical reasons on a student’s IEP or 504 plan
- Documented accommodations on a student’s IEP or 504 plan
- Documented family needs/emergencies
- Specific instructional reasons with authorization from the school
FERPA LAW
The Family Educational Rights and Privacy Act (FERPA) and New York State Education Law 2-d, and local regulations, such as Chancellor’s Regulation A-820, protect students’ “personally identifiable information” (PII). These laws also place responsibilities on the DOE and outside parties that are given access to children’s PII, including the requirement for the DOE and schools to provide families with the following annual notices:
